Terms and Conditions – General Books and Goods

These are general terms and conditions and apply to Bookbinding by Crawford and all affiliated companies (52 Print Solutions) some terms and conditions are relevant to only some services but not necessarily all.

In these terms and conditions Bookbinding by Crawford is referred to as “we” or “us” and “our” refers to the property of Bookbinding by Crawford. You as a user of our site are referred to as “you”.

By our service, you agree to provide us with up to date and accurate information about yourself. This information is required by Bookbinding by Crawford to complete the service you have requested.

By using our services you agree not to reproduce, duplicate, copy, sell, resell or exploit any part of any of our services, use of the service, or access to the service for any commercial purposes or promotional services without written consent prior to publishing.

The Site

You acknowledge and agree to be bound by the terms of our privacy policy.

We provide “hyper-links” from the Site to web sites of third parties. Please note that we have no control over and are not responsible for the content of such web sites and accordingly make no warranty or representation as to their contents. We provide these links for your convenience only but we do not necessarily endorse the material on those web sites. We are not responsible for any transaction conducted between you and any such third parties and such a transaction is subject to the third parties terms and conditions.

We make no representation or warranty of any kind with respect to the Site or its contents and we hereby disclaim all such representations and warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in this Site. The information contained in this Site may contain technical inaccuracies or typographical errors. All liability howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Intellectual Property Rights; the content of the Site and all intellectual property rights connected to the Site are owned by us. Such rights include, but are not limited to the underlying software, copyright in the text, logos, pictures, photographs, graphics icons and design of the Site, the look and feel and structure of the Site, trade marks, domain names and database rights. You may retrieve and display the content of the Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all copyright and proprietary notices. You are not permitted to reproduce, modify, copy, distribute or use for commercial purposes any of the content on the Site without written permission from us.
 No licence is granted to you in these Terms and Conditions to use any trade mark of Bookbinding by Crawford or any of our affiliated companies.

Terms of website and software use

These terms are the terms upon which users of the Bookbinding by Crawford website at www.BookbindingbyCrawford.co.uk are bound to. The Site is owned, maintained and operated by Bookbinding by Crawford. These terms will remain in force and be legally binding on you until such time as either you or we terminate this agreement. By accessing our website or partner websites you agree to these terms also. These terms are imposed upon you on your first visit to the website or when any service is ordered/downloaded or enquired about. Any service or website that is added to Bookbinding by Crawford prior to updating these terms are also bound by this agreement, although we strive to keep all terms and conditions up to date.

These Terms and Conditions agreement set forth the legally binding terms for your use of our services. By using our services, you agree to be bound by this agreement, whether you are a visitor (which means that you simply browse the Website) or you are a member (which means that you have registered with Bookbinding by Crawford and set up an Account). The term user refers to a Visitor or a Member.

Thesis Online (full thesis terms appear on online order form)

Important Information on delivery options: We can arrange to deliver to any single UK mainland address by secure carrier normally within 3 days. Most deliveries by carrier are made the next day but please make sure if using this method that there will be somebody in to receive and sign for delivery otherwise the parcel will be returned to us.
 We can also despatch to Highlands and Islands or to Ireland on a 3-day basis and will be pleased to quote for deliveries overseas if requested in advance. Costs for packaging and delivery by the different options are shown inclusive of VAT.

While all efforts are made to ensure your work is sent out/ready within deadlines, the company, (Bookbinding by Crawford) does not accept any responsibility whatsoever for late submissions which may be due to production issues during the print and bind process. Nor can any responsibility be taken for the loss of work in transit. At several times of the year the volume of work can cause minor delays and we do our best to advise on these where possible however this is not always possible if there is a sudden influx of work. Please bear with us at these times of the year, we do everything we can to meet agreed times, very rarely are there delays, however if there are they should not exceed an hour or two at most.

Whilst all efforts are made to deliver your work accurately, our responsibility for delivery by Business Post is limited to having a signed proof of delivery which will be provided by Business Post on request. Our own drivers will also have signed paperwork and responsibility is limited to this also. No responsibility whatsoever is taken for the loss of work by normal postage. Any other loss, in the event of a successful claim against the company is limited to the cost or producing print and binding at the companies expense.

Access

Whilst the Site can and may be accessed and used by persons outside of these regions, we do not represent or warrant that the information on this site or any service provided through Bookbinding by Crawford complies with the required regulations of any other region. If access to our website or services is gained from outside these areas then you are personally responsible for compliance of any local laws.

We hold the right to reserve any content, logos, text, images and services used on our site and at no point should this content be copied, sold, rented, leased, licensed, sub-licensed or granted in any way or otherwise assigned to any third party. If any part of our site is required to be copied or distributed then our written consent must be requested prior to publishing. This site is intended for personal/individual use only.

Book Content

Content includes text, files, images, photos and other material. Your content includes content that you include in the books, submit to Bookbinding by Crawford for book and print services; Bookbinding by Crawford has no ownership or responsibility in any of your book content.

Ownership of your content, you represent and warrant that you own or otherwise have the right to duplicate or use the content in your ordered product and have the right to provide it for our printing and binding services. Your Book Content does and will not violate the privacy rights, publicity rights, copyright rights, or other rights of any other person or entity.

License, in order for Bookbinding by Crawford to provide you with our services, you hereby agree a license to reproduce and distribute your book content for the purpose of printing. You agree that Bookbinding by Crawford reserves the right to maintain the electronic files for any book(s) to fulfill any further orders which may be placed for such Book(s) and to maintain an archival copy of the printed Book. You also grant Bookbinding by Crawford permission to use these archival copies for demonstration and or photographic purposes so long as it does not breach any human rights law or disclose any personal information relating to you.

Prohibited Content, you agree that you will not submit for print services any prohibited content. This content includes book content or other content that is offensive or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, bullies, harasses, or advocates stalking, bullying, or harassment, of another person; involves the transmission of “junk mail,” “chain letters,” unsolicited mass mailing, or “spamming,”; is false or misleading or promotes, endorses or furthers illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; promotes, reproduces, performs or distributes an illegal or unauthorized copy of another person’s work that is protected by copyright or trade secret law, is involved in the exploitation of persons under age in a sexual or violent manner, or solicits personal information from anyone under age; violates any applicable law, including, but not limited to laws and regulations governing export control, unfair competition, anti-discrimination and false advertising; (xi) involves commercial activities that are detrimental to the interests of the Bookbinding by Crawford or otherwise violates this Agreement or creates liability for Bookbinding by Crawford.

Bookbinding by Crawford reserves the right to refuse to print and bind any book that contains prohibited content, and you agree to indemnify and hold Bookbinding by Crawford and its subsidiaries, affiliates, officers, employees, suppliers, service providers, and partner companies harmless for any claims, losses, liabilities and expenses arising out of or relating to any breach of this section.

Print Quality

At no point have Bookbinding by Crawford or its partner companies claimed to print with anything other than high quality digital print presses. No colour correction or file manipulation will be carried unless specifically requested, files will be printed as supplied.

Ownership of Goods

Ownership shall not pass to you until we have payment in full for the books /goods

Book Sizes

Sizes given in any product description are only approximate, we strive to maintain accuracy in book sizes as we do all other aspects of manufacture but books can be undersize or over size but will always remain around dimensions supplied. Please expect illustrated hardbacks/cloth bound books and bonded leather books to be oversized as the case must outsize the book block. Dimensions for these products relate to the page sizes.

Shipping

Bookbinding by Crawford accepts no responsibility for delay whatsoever, delivery should take place within 2 working days for 2nd class and 1 working day for 1st class. Please do not contact us if your product does not arrive in this time period. If however you do not receive your package within 8 working days please contact us and we will deal with your case accordingly. If your package cannot be posted through your door then a free re-delivery will be scheduled or a collection card will be posted through your door.

Downloadable software and products

By downloading any software, using a service or ordering a product that Bookbinding by Crawford and partner companies provides, you are doing so at your own risk. By doing any of the above you agree to the extent legally permitted under the applicable law that Bookbinding by Crawford are not responsible for any loss, damage to you or anybody related, voiding of warranties, financial loss, physical injury due to finished products or software malfunctions. Bookbinding by Crawford will not be responsible for damage to the operating machine which runs the software as we will also not be liable for any financial loss due to the software.

By downloading software you acknowledge that the software may contain bugs and errors that could potentially damage your operating machine. Software is provided to you as is at the time of download and Bookbinding by Crawford holds the rights to remove products and anything within the products but at the same time reserves the right to update software, products and anything within the products when it feels is necessary. Finally Bookbinding by Crawford holds the right to remove customer’s access to the software as and when necessary.

Price and Payment

The price payable for the goods and services you order is set out in the Site. All thesis printing and binding costs are zero rated for VAT (including the binding service charge, and the cost of the extras. Delivery prices include VAT as stated in the Site.

If you choose to have the goods delivered to you by courier the price for this service is set out in the Site. For users outside the UK and Ireland an additional charge will be made for delivery.

Payment can be made by credit or debit card. Your details are securely processed by Realex & Secure 3D. We do not receive or store any credit or debit card information; only a confirmation that the transaction has been authorised.

For all new customers full payment is required prior to collecting/receiving work. Payment for goods received can be made via online banking or cheque. If a customer has been given credit terms the terms are 30 days from receipt of delivery. Bookbinding by Crawford holds title to all goods until paid for in full.

Purchase of Goods or Services

Any purchase of goods and services from us will be governed by these Terms and Conditions. The goods and services offered by us consist of:- Conversion of your dissertation to PDF format; Printing of your dissertation; Binding of your dissertation. Once the goods and services have been agreed by you on the Site, payment for the goods and services will be requested. We must receive payment of the whole of the price for the goods or services before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by (sending an email to you at the email address you provide). Our acceptance of your order brings into existence a legally binding contract between us.

Limited Liability

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, you must notify us in writing within 10 working days of the delivery of the goods.

Until such time as the ownership passes to you, you shall hold the books/goods on our behalf and keep them safe.

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, you must notify us in writing within 40 days of the date on which you ordered the goods.

If you notify us of a problem under this condition, our only obligation will be, at your option: To make good any shortage or non-delivery;
 To replace or repair any goods that are damaged or defective; To refund to you or provide a credit note for the amount paid by you for the goods in question in whatever way we choose.

Where you have paid for our conversion service, we accept no liability for your inability to retrieve documents if this is due to your own software limitations.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including, but not limited to loss of
profits, business, data, income or goodwill) howsoever arising and our liability limited to the amount paid by you for the goods or services under clause above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Cancellation of your Order

You cannot cancel your order if you have requested the thesis/dissertation printing and binding service as this is personal to you.

Cancellation by Us

We reserve the right to cancel the contract between us if:

We have insufficient stock to deliver the goods or undertake the services that you have ordered; We do not deliver to your area; or
one or more of the goods or services you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. We don’t want to do business with you.

If we do cancel your contract we will notify you by e-mail within seven days and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered or for deadlines not being met.

Delivery of goods to you

We will deliver the goods ordered by you to the address provided by you for delivery at the time you make your order. You must provide an accurate delivery address and we do not guarantee delivery to you.

Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order. Any indication given of the date for delivery is an estimate only and shall not be binding on us.

You will become the owner of the goods you have ordered when they have been paid for and delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their damage, loss or destruction.

Materials and Material Colours

Colours shown in any colour charts may not always match the true colour of the book you receive; this is due to varying screen resolutions. The colours do not tend to vary too much but your attention should be drawn to this.

We cannot also be held liable for any changes in the colour of cloth/leather or other materials. This includes discontinuation of certain lines/colours or materials as these factors remain outside of our control.

Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Third Party Rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Assignment

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

Waiver

If you breach these Terms and Conditions and we ignore this, we will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Changes

We reserve the right, at our discretion, and without notice to you, to modify, add to or change the Site, these Terms and Conditions, our Privacy Statement and any other policies at any time and any such changes will be effective immediately on being posted to this Site. Changes are indicated by the issue date on the Site.
